For our project, we decided to work on the recruitment process, how to implement it globally and what steps should be taken. First, to go global and open another branch in Bahrain, in its capital Manama, as a beginning, an analysis should be done about the country we’re expanding to.

As a first step, we hired a Bahraini lawyer to teach us about the labor law of Bahrain, as an initial step, we discovered that starting a new business in Bahrain requires a local partner, the partner can be a company or an individual from Bahrain, that has the majority interest in the company, which means that he has control over the business and can close it up, and he is not obliged to do any financial contributions to the company. After registering the company, we have to go to the Ministry of Commerce and show them that you are able to invest in this project; usually you would have to invest between $10000 and $50000, depending on the company. This sum of money is considered as a guarantee from any liabilities but you can take them back after a while when everything is working fine.

Anyone running a business which recruits staff in Bahrain needs to be aware of the constitutional responsibilities and obligations relating to:

Recruitment:

• An employer is obligated to give priority to Bahraini people and thereafter to other Arab people.

• There is a compulsory minimum ratio of the amount of Bahraini nationals to the amount of non-Bahraini nationals.

• Companies are under a governmental duty not to discriminate between Bahraini and non-Bahraini nationals.

Employment contract:

• The employment contract should contain the terms of employment approved by both parties.

• The employment contract outlining the terms and conditions of employment must be in writing.

• It is obliged to comply with the Bahrain Labor Law.

• Any term or condition in the agreement which does not comply with Bahraini law will be considered null and cancelled.

Registration and compulsory insurance:

• Employers must register employees in the Ministry of Labor and the Social Affairs and obtain a certificate of registration.

• Employers may also want to consider life insurance.

Wages:

• Salaries are paid in cash or in kind to a worker under an employment contract.

• There is no domestic minimum wage.

Holidays and week days of rest:

• An employee works for six days per week not more.

• Fridays are considered to be the weekly day of rest with a complete pay.

• The employee is permitted to leave for official public holidays.

Annual leave:

• All employees are authorized to have at least 21 paid days as annual leave.

• Rises to 28 days after 5 years of employment.

Sick leave:

If an illness occurred, certified by an approved doctor or hospital, an employee is entitled to a total of 45 absences in each year of employment. This is divided as follows: 15 days on full pay, 15 extra days on half pay and 15 other days without pay.

Pilgrimage:

• A Muslim member, employed for 5 successive years, will have the right to leave of 2 weeks on full pay.

Maternity leave:

• A female employee has the right to a maternity leave of 45 days on full pay and this period may be stretched by a further 15 days without pay.

Disciplinary measures:

• If an employer wants to take a disciplinary act or discharge an employee, he must follow the permitted procedure and the requirements of the law.

•The disciplinary procedures which can be taken against a member of the staff includes: warnings, fines, suspension and discharge.

Statutory dispute resolution guidelines:

• A claim must be presented to the Ministry of Labor which will take steps to ease a friendly settlement among the parties.

• If the parties fail to agree upon a settlement, the Ministry of Labor will refer the argument to Court.

Termination:

• A contract done for a period of duration automatically terminates at the end of that period, unless the both parties continue to abide by its terms after its termination.

• Employers are recommended to take advice before a discharge on the possible rights as the employee may have a possible legal claim for compensation for termination on illegal grounds.

• Examples of unlawful termination include:

a) Termination of a female employee due to getting marriage, pregnant or on maternity leave.

b) Termination without abiding the lawful disciplinary actions and rules.

c) Termination for a breach of an agreement which is not serious enough to permit it.

d) Termination throughout a sick leave or any other leaves that are allowed by the law.

e) Termination during an incomplete investigation and disciplinary action.

NON-BAHRAINI EMPLOYEES:

Registration:

• The establishment must register all non-Bahraini employees in the Bahrain with the Labor Market.

Regulatory Authority and receive a valid work permit:

• Foreign employees must be medically appropriate, have entered the nation legally, possess a lawful passport, and hold a residence document and work permit.

Leaving indemnity and homecoming travel expenses:

• The departure indemnity is payable on the suspension of employment

• Calculated by the situation of the employee’s length of service and whether the employment has been dismissed by the employer or the employee.

• The employer must also pay a fee for the non-Bahraini employee for a return plane back to their country.

According to the Law, we need a local partner; as such we hired an expatriate to teach us about the country’s culture, environment and to give him an orientation about our company, its culture, objectives and strategy so he can lead the expansion in Bahrain. His knowledge of the country and experience working in it, gave us a lot of help to know what to expect and how to build our company there. We learned the following:

Culture of Bahrain:

The family/ Tribe: In Bahrain they value a lot the family, the family comes first above everything and even in their business they value favoritism, if you are a member of a family they prefer to hire you, because they trust a family member.

Greetings: Men usually greet with the phrase "Salaamu Aleikum" (it means, "peace be upon you").  The appropriate response is "Wa'aleikum al-salam", which refers to, "and on peace be with you."  This is usually a warm handshake occurs, always use the right hand. Women usually salute each other in a similar way to men.  Handshakes (always use the right hand) and/or kisses on each cheek are common.  During initial meetings, an oral greeting is also suitable for many people. Greetings amongst Men & Women is different, social communications between non-related members of the conflicting sex are not common, the handshake is not included in the introduction. Always wait for the woman to initiate. 

Women in Bahrain: are publicly active, they have the right to vote. Usually women in Bahrain are housewives, but with the advancement in the last years it has been acceptable to have a job and work. They are highly educated and their level of education is the highest between the Arab countries

Cloth: Men wear conservative suits and ties or "Abaya". Darker colors are more preferable. Women are conservative. Expensive accessories, skirts higher than the calf, low necklines attire should be avoided. Pants are suitable and still some business women were a "Hijab".

Relationships and communication: Bahrainis are very patient in their communication. They like to take their time in making decisions, and don’t like to be rushed, even if they have a deadline.

Business meeting etiquette: Timeliness is very important for them, never come late, preferably earlier. In July and August, because of the worst of the summer heat, almost all Bahrainis leave their country, so do not try to schedule a meeting during these 2 months. They prefer morning meetings and they are often interrupted, since they are usually done in open-door, not in an office.

Use of titles: a good title to give to old men is 'Sheikh', or 'Hajji' for a religious person .Titles are very important to Bahrainis.

Eye Contact: Indirect eye contact with an elderly people and women are favored in Bahrain. On the contrary, while having a conversation with a member of the same gender direct eye contact is a must.

Taboos: Don’t point any part of your feet at a person. If you decline an offer of coffee, tea, food, etc… is an act considered to be offensive. It is disrespectful to present or take anything with your left hand. Taking pictures of women wearing a black "Hijab" is considered a taboo.

Law & Order: Bahrainis are prohibited to drink alcohol since they follow are of Muslim origins, but it is acceptable for foreigners. The legal age for smoking is 21 and "Sheesha" is banned in public places.

Job Fairs: This method is used to attract and meet large number of candidates in a short period of time and at a specific place. Since we are willing to attract the largest number on university graduates then most of the job fairs must be at university campuses. This method is used to attract top public relations personnel.
